By understanding and researching patents both still protected under United States federal law, and those entered into the public domain we can best utilize non-protected design concepts and further develop those protected under law while remaining within the guidelines of Title 35 of the United States Code.

Patent law is important as it defines and regulates all action regarding intellectual property within the United States, and when globally recognized, abroad. The following laws found in Title 35 of the United States Code were the main contributing factors used to refrain from accidental patent infringement.

35 U.S. Code § 101 – Inventions patentable
35 U.S. Code § 102 – Conditions for patentability; novelty
35 U.S. Code § 103 – Conditions for patentability; non-obvious subject matter
